01. General

“www.myareapage.com” (hereinafter, the “Website”) is owned and operated by Stickjoy Ventures Private Limited, (hereinafter referred to as “Company”), a private limited company incorporated under the Companies Act, 2013, having its registered office at IF – 08/03, New Town Heights, Sector 86, Nawada-Fatehpur, Gurgaon – 122004, Haryana, India.

This document is an electronic record published in accordance with the provisions of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the Rules and Regulations, Privacy Policy and Terms of Service for access or usage of the website and being generated by a computer system, it does not require any physical or digital signatures.

For the purpose of these Terms of Use, along with any amendments to the same, and wherever the context so requires.

“You”, “Your”, “Yourself” or “User” shall mean and refer to the person visiting, accessing, browsing through and/or using the Website at any point in time and shall include the “Clients/Customers/Advertiser/Promoter”. Further, it shall also mean and refer to persons who are “Vendors” and “Service Provider” for the Website. However, where a Client/Customer or Vendor or Service Provider is mentioned specifically it shall only mean and refer to that class of User.

The term “We”, “Us”, “Our” shall mean and refer to the website and/or the Company, depending on the context.

This Agreement shall cover your usage of the Website as a User, which shall include Customers, Vendors/Service Providers and any Third – Party website, company or individual who provide any form of Service directly or indirectly for financial and/or non- financial or any other benefits.

The headings of each section in this Agreement are only for the purpose of organizing the various provisions under this Agreement in an orderly manner. These headings shall not be used by either party to interpret the provisions contained under them in any manner. Further, the headings have no legal or contractual value.

We hold the sole right to modify the Terms of Service without prior permission from You or providing notice to You. The relationship creates on You a duty to periodically check the Terms of Service and stay updated on its requirements. If You continue to use the Website or avail any of its services without registration following such change, this is deemed as consent by You to the so amended policies. Your continued use of the Website is conditioned upon your compliance with the Terms of Service, including but not limited to compliance with the Terms of Service even after alterations, if any.

www.myareapage.com is an online platform that provides publicly available information-sharing services to its users. We provide search results,  listings, deals, and services which may or may not relate to a specific region or topic . The users may acquire contact information, address and other details of the listing they are viewing on the website.

The website displays publicly available information free of cost for all to access which comprises of logos, names, contact details, address, email, photos, videos, social media accounts of all kinds of the service provider, such as including but not limited to the vegetable vendor, doctor, plumber etc. Further, the website has a paid service where a service provider may pay us to advertise his/her profile on the website and we shall share details of their services and business with other users. Such paid service may be availed of by choosing the appropriate plans such as the monthly plan. ALL PAYMENTS MADE BY SERVICE PROVIDER TO US ARE NON-REFUNDABLE AND WITHOUT ANY BUSINESS GUARANTEE. After the end of the plan, we may remove or retain certain information related to such a service provider. All the offers, features and details of any of the plans are subject to change at any time at the discretion of the company, without any intimation or notice.

The Website shall also maintain information related to but not limited to the malls, shopping outlets, entertainment centres, various businesses, services, events and happenings in order for the users to be aware of the activities around them. Such activities shall include but not be limited to the fete, campaigns, cultural events, etc. No prior permission has been sought for reporting of such information/events from any of the business management or service providers. The correctness of the information provided needs to be verified by the User before availing of any of the details or services from any Third Party on the Website and the Website shall not be responsible for any incomplete or inaccurate information that may be displayed on the Website.

Further, the website may also display a buy and sell option wherein Users may send Us the details to post pictures and description of any item they wish to rent out or sell/buy such as including but not limited to renting a flat, selling new/second-hand furniture, etc. Such details may be posted or removed as and when deemed fit at Our sole decision on chargeable or free-to-post basis. The Website shall only be a platform for the display of such pictures and description of products and any information, which may lead to connections between buyers and sellers. The Website shall not be responsible for any consequences or implications arising from any interactions between buyers and sellers.

The website shall also maintain information regarding the emergency service providers and their contact details. Users may contribute any new information by sending the information to Us and we shall only post such information as and when we choose or deem relevant. Further Users are aware that they may email us in the event they want certain information displayed on the website to be removed/altered and we may do so at our sole discretion. The information contained regarding emergency services is posted only for general purposes and the Website shall not be responsible for any incorrect details or any consequences or implications arising from the use of the information. Users shall be required to do their own research to verify the accuracy or the updated nature of the services or any details provided by Us and We shall not be liable for any consequences arising from the User’s use of any such services and details provided on the Website.

03. Registration

To use the services provided on the Website, you do not have to register yourself on the Website or any other platform. The information on the Website is publicly available. 

There is login authentication on the site and it is used only for Website administration purposes. 

Information collected about You is subject to the Privacy Policy of the Company, which may be read as part and parcel of these Terms of Use. 

3.1 Information collected by Company/Websites’s campaign

We have email subscription functionality where Users may voluntarily provide their first name, last name, email address and other necessary information to subscribe to our newsletter services. Users are given the facility to unsubscribe from our newsletters at any time.

The Website also runs its own campaigns/promotions which collects Users’ relevant information which they may voluntarily provide for participating in the campaign. We can choose to use this information for future campaigns/promotions without express permission from the User. INFORMATION COLLECTED BY THE WEBSITE IS NEVER SHARED/SOLD TO ANY THIRD PARTY.

In the event that the subscriber wishes to stop receiving our internal marketing, special offers or promotional calls/email messages/text messages, the subscriber may unsubscribe via email at [ADMIN@MYAREAPAGE.COM]. The subscriber agrees and acknowledges that it may take up to fifteen (30) business days for the Company to give effect to such a request.   

It is expressly agreed to by the Parties that any information shared by the subscriber with the Company shall be governed by the Privacy Policy.

3.2 Information collected by Advertisers’ campaign

The platform also supports/promotes Advertisers to run their own campaigns/promotions on the Website. Any information collected on such campaigns/promotions belongs to the Advertiser and the Website will not be responsible for how this information is used by the Advertiser. Such a disclaimer would be specifically mentioned in the campaign and the User can choose not to participate or not participate in the campaign if he/she does not agree with it.

The subscriber expressly agrees that notwithstanding anything contained hereinabove, it may be contacted by the advertiser/promoter or any of its affiliates/partners and the subscriber agrees to indemnify the Company from any and all harassment claims. 

04. Eligibility

Services on the Site would be available globally. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Site.

However, if you are a minor, i.e. under the age of 18 years and over the age of 13 years, you may use the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. We reserve the right to terminate or refuse your registration, or refuse to permit access to the Site, if it is discovered or brought to its notice that you are a minor.

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, brand names, descriptions, sounds, videos, music and artwork (collectively, ‘Content’), is generated/provided or based on publicly available information and We make no guarantees regarding the quality, the accuracy, integrity or genuineness of such Content. All the Content displayed on the Website is subject to copyright and shall not be reused by any party (or third party) without the prior written consent of the Company and the copyright owner, in case of publishing of brand logos, trademarks or other third-party owned Content. The Company may edit any information as per its discretion and requirement and shall not be responsible for the updation, correctness, authenticity, result or loss on account of use or perusal of any of the Content.

We post blogs on various topics written with the information available and shall not provide any warranties or guarantees relating to the correctness or updation of the information that has been displayed through the same. We shall own the right to edit and modify all such Content, whether it is paid or unpaid to the external bloggers. We can use the whole or part of the Content in any manner including for commercial use and shall hold the copyright on the content and can choose to change the information provider, author name and modify it as per our discretion. No blogger or content writer can use the whole or any part of such Content in any manner without written approval from Us.

The Website may provide locations of certain places using Google Maps and other such social platforms, which are all indicative in nature and we do not make any warranties or guarantees pertaining to their accuracy or their updated nature. Users shall be required to do their own research to verify the accuracy or the updated nature of the locations or addresses provided by Us and We shall not be liable for any consequences arising from the User’s use of location details provided on the Website.

The Website may, from time to time, purchase domain names at its discretion, which it shall be entitled to keep, sell or transfer in any manner as per our discretion. The Website’s use of generic terms, including ‘DIRECTORY’, ‘INFORMATION GUIDES’, etc. are all to facilitate ease of communication between the Website and Users and shall not be definitive in this regard. 07. User Obligations

You are a restricted user of this website.

13. Disputes And Jurisdiction

All disputes involving but not limited to rights conferred, compensation, refunds, and other claims will be resolved through a two-step Alternate Dispute Resolution mechanism.

1. Stage 1: Mediation. In case of a dispute, the matter will first be attempted to be resolved by a sole mediator who is a neutral third party and will be selected at the mutual acceptance of a proposed mediator by both parties. Both parties may raise a name for the sole mediator and in the case both parties accept the proposed name, the said person shall be appointed as sole mediator. In case the parties are not able to reach a consensus within two proposed mediators, the Company reserves the right to decide who the final mediator is. The decision of the mediator is not binding on both parties.
2. Stage 2: Arbitration. In case that mediation does not yield a result suitable or preferred by any one of the parties, arbitration may follow, the award of which is binding on both parties. The Arbitration Board shall comprise three members – one appointed by each party and the third member to be nominated by the two appointed members by mutual consent. Arbitration shall be held at Gurgaon, Haryana, India. The proceedings of arbitration shall be in the English language. The arbitrator’s award shall be final and binding on the Parties.

If the dispute cannot be resolved by this two-step Alternate Dispute Resolution mechanism, it shall be referred to the courts at Gurgaon, Haryana, India.

Notwithstanding the foregoing, the Client and Service vendor shall always remain subject to the terms of Our user Agreement.
2. Waiver: The failure of either party at any time to require performance of any provision of this Agreement in no manner shall affect such party’s right at a later time to enforce the same. No waiver by either party of any breach of this Agreement, whether by conduct or otherwise, in any one or more instances, shall be deemed to be, or construed as, a further or continuing waiver of any other such breach, or a waiver of any other breach of this Agreement.
3. Severability: If any provision of this Agreement shall to any extent be held invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions of this Agreement shall in no way be affected or impaired thereby and each such provision of this Agreement shall be valid and enforceable to the fullest extent permitted by law. In such a case, this Agreement shall be reformed to the minimum extent necessary to correct any invalidity, illegality or unenforceability, while preserving to the maximum extent the rights and commercial expectations of the parties hereto, as expressed herein.
